Forfeiture of Lease (Housing Act 1988)
The policy provides cover to a lender for any actual financial loss in relation to the mortgage resulting from a landlord in the lease to the property exercising or attempting to exercise their right to terminate the lease by virtue of Ground 8 of the Housing Act 1988 for non-payment of rent on the basis that the lease is deemed to be an assured tenancy pursuant to Schedule 1, Section 3A of the Housing Act 1988, i.e. the yearly rent payable under the lease is over £1,000, if the property is within Greater London, or over £250 if the property is located elsewhere and has not been paid for a period of 3 months or more.
Freehold Rent Charge
The policy provides cover for any actual financial loss resulting from a rent charge owner whose identity was unknown to the insured at the start of the policy enforcing or attempting to enforce a freehold rent charge including the cost of arrears and future rent charge payments, the enforcement of any restrictive covenants associated with the rent charge and the legal right of re-entry as a consequence of such non-payment and/or breach of said covenants.
Manorial Rights
The policy provides cover for any actual financial loss resulting from any third party enforcing or attempting to enforce manorial rights and/or claiming or attempting to claim that permanent structures and/or services present at property at the start of the policy constitutes a trespass on or infringement of such rights.
Mineral Rights
The policy provides cover for any actual financial loss resulting from any third party enforcing or attempting to enforce mineral rights and/or claiming or attempting to claim that permanent structures and/or services present at property at the start of the policy constitutes a trespass on or infringement of such rights.
